500 General Information

The Board of Trustees of The California State University has established regulations in Title 5 of the California Code of Regulations to govern the employment of State Universitypersonnel. The Higher Education Employer-Employee Relations Act (HEERA) allows collective bargaining for most CSU employees. In the case of any conflict between CAP and the provisions of the appropriate collective bargaining agreement(s), the latter will prevail.

The offices of Academic Personnel and Human Resources, in collaboration with the president, program managers and department administrators, are charged with implementing personnel policies.

501 Nondiscrimination Policy

Cal Poly and its auxiliary organizations are committed to maintaining and implementing employment policies and procedures in compliance with applicable state and federal nondiscrimination and affirmative action laws and regulations and CSU trustee policies, to ensure equality of opportunity in all aspects of employment. The University supports an environment free of unlawful discrimination and workplace harassment on the basis of race, color, religion, national origin, ancestry, sex, sexual orientation, marital status, pregnancy, age, disability, medical condition and covered veteran status. Moreover, retaliation against individuals who have or are believed to have filed a discrimination complaint (including sexual harassment), opposed a discriminatory act, or participated in a discrimination investigation or proceeding, is prohibited. Cal Poly shall, upon request, provide reasonable accommodation to qualified individuals with a disability or medical condition so that they may perform the essential duties of their jobs, unless doing so would impose an undue hardship on the University. Reasonable accommodation is to be determined by the University following receipt of an individual’s request for accommodation and subsequent engagement in an interactive process with the individual to identify the nature and extent of the individual’s restrictions and the appropriate reasonable accommodation.

502 Administration Roles

502.1 Program Manager

The program manager holds the title of vice president or dean and is responsible for a division or college.

502.2 Department Administrator

The department administrator is the employee appointed by the program manager to lead a departmental unit. For the purposes of this policy, the term department administrator includes departmental directors/chairs/heads.

503 Employee Categories

Cal Poly employees are classified into five major categories: academic, management, staff, student, and volunteer. Employees of the auxiliaries are not State University employees and should consult their respective personnel policies.

503.1 Academic Employees

Instructional faculty members, librarians, coaches, and counselors are covered by the collective bargaining agreement for Unit 3-Faculty, represented by the California Faculty Association. The Academic Personnel department is responsible for coordinating the implementation of personnel policies and procedures for faculty unit employees and academic student employees in Unit 11 (see CAP 503.4).

503.2 Management Employees

Management employees are covered by the Management Personnel Plan (MPP) cited in Title 5, California Code of Regulations, with salary structure, evaluation and benefits - among other matters - being governed by these regulations. Continuation of management assignments is at the pleasure of the President (or designee).

503.3 Staff Employees

Staff employees include all employees except those in academic, management, student or volunteer positions, whether covered by a collective bargaining agreement or not. Most staff employees are covered by collective bargaining agreements as follows:

Unit 1: Physicians, represented by Union of American Physicians and Dentists

Unit 2: Health Care Support, represented by California State University Employees Union

Unit 4: Academic Support, represented by Academic Professionals of California

Unit 5: Operations Support, represented by California State University Employees Union

Unit 6: Skilled Crafts, represented by State Employees Trades Council

Unit 7: Clerical/Administrative Support Services, represented by California State University Employees Union

Unit 8: Public Safety, represented by Statewide University Police Association

Unit 9: Technical Support Services, represented by California State University Employees Union

A few staff classifications are excluded from collective bargaining coverage, such as Helper Aid and positions designated as Confidential.

Confidential employees, as defined in HEERA, are those who are required to develop or present management’s position with respect to meeting and conferring with the exclusive representatives of collective bargaining or whose duties normally require access to confidential information that contributes significantly to the development of management’s position.

503.4 Student Employees

Student employees provide part-time assistance in support of the instructional and administrative operations of the University. Student employees are covered by workers’ compensation insurance.

All students in the classifications of teaching associate, graduate assistant and instructional student assistant are covered by the collective bargaining agreement for Unit 11, Academic Student Employees, represented by the International Union, United Automobile, Aerospace and Agricultural Implement Workers (UAW), AFL-CIO and its Local Union 4123.

503.5 Volunteer Employees

Volunteer employees perform work or provide services for the University without compensation. They are not covered by a collective bargaining agreement. Volunteer employees are covered by workers’ compensation insurance.
